1. Definitions
These terms apply to all Klikwork services, including training, events, consultancy, subscriptions, and AI implementation projects. Specific clauses apply only to fixed-price implementation projects and are marked accordingly.
Klikwork BV, based at Assendorperdijk 1, 8012 EG Zwolle, The Netherlands, is registered with the Dutch Chamber of Commerce under number 24388851. Hereafter referred to as "Klikwork."
Client: Any individual or legal entity that enters into an agreement with Klikwork or on whose behalf Klikwork provides services.
Agreement: The agreement between Klikwork and the Client, regarding services such as training, subscriptions, or consultancy.
Training: Any training service provided by Klikwork, regardless of its format (in-person, online, live, or recorded).
Participant: The individual participating in a training or on whose behalf the Client has agreed with Klikwork.
Masterclass: A short-form, fixed-date training session focused on specific topics, tools, or techniques, primarily educational and demonstrative in nature.
Bootcamp: An intensive, time-bound, hands-on training program delivered on-site or online, focused on practical application, building, and troubleshooting of AI and automation workflows.
Events: Online or offline gatherings focused on knowledge sharing, networking, or product demonstrations, distinct from structured training programs.
Cohort-based training: A training format where Participants progress through content and sessions together within a fixed start and end date.
Consultancy: Strategic advice regarding AI, automation, sourcing, or recruitment strategy.
Implementation Services: Design and delivery of AI and automation workflows, using no-code/low-code tools (e.g., n8n), APIs, scripts, and prompt engineering.
Klikwork+: A subscription-based service providing access to the community portal, online masterclasses, and exclusive resources.
AI Recruitment Engineer: A structured training program provided by Klikwork to help recruiters and recruitment agencies build AI-driven workflows using tools like n8n, large language (AI) models, and automation templates. This includes both fixed-term cohorts and a subscription-based model with continuous access to new content, prompts, workflows, and support.
2. Prices and payment terms
Payment methods
In-company training: Invoice only.
Consultancy & implementation: Invoice only.
Klikwork+ and AI Recruitment Engineer subscriptions: Wero/iDeal, Credit Card, or Bancontact.
Masterclasses, Bootcamps, Events & Cohort-driven tracks: Payment via invoice, Wero/iDeal, PayPal, Credit Card, or Bancontact, depending on selected track.
Consultancy & implementation: Invoice only.
Klikwork+ and AI Recruitment Engineer subscriptions: Wero/iDeal, Credit Card, or Bancontact.
Masterclasses, Bootcamps, Events & Cohort-driven tracks: Payment via invoice, Wero/iDeal, PayPal, Credit Card, or Bancontact, depending on selected track.
Payment schedules
(In-company) training, bootcamp, masterclasses:
- Invoice issued upon confirmation
- Payment must be received at least 14 days before the training start date
Implementation projects (fixed price):
- 50% at project start
- 40% after test environment delivery
- 10% upon final acceptance
Consultancy (hourly):
- Invoiced monthly in arrears, 14-day payment term
Subscriptions:
- Billed at the start of each term
- Auto-renewed unless cancelled 14 days before renewal date
Late payments:
- Legal interest + €75 administrative fee
3. Cancellation and rescheduling
In company training
- Cancellation/rescheduling by email (training@klikwork.com):
- Up to 1 month before: €150 admin & reservation fee.
- Less than 1 month: 50% of the agreed fee.
- Less than 1 week: full fee.
Bootcamps, cohorts, and masterclasses
- Registration for bootcamps, cohorts, and masterclasses is binding.
- More than 30 days before the start date: 50% of the fee is due, 30 days or less before the start date: 100% of the fee is due.
- No refunds will be issued once:
Preparation materials, pre-access, or recordings are made available, or it has started.
Seat transfers to a colleague are allowed upon written request, subject to approval.
Events
- Event tickets are non-refundable.
Tickets are transferable to a colleague upon written request at least 7 days before the event, subject to approval.
Klikwork+ and AI Recruitment Engineer
Klikwork+ or AI Recruitment Engineer subscriptions can be cancelled with at least 14 days’ notice before the renewal date via training@klikwork.com.
Rescheduling of coaching sessions is only possible with 48 hours' notice.

4. IP & confidentiality
All intellectual property rights related to Klikwork’s training materials, documentation, code, and automation assets remain the exclusive property of Klikwork.
Materials, slides, templates, recordings, and documents provided during training are for personal, non-commercial internal use only and may not be copied, shared, or distributed without written permission.
Source code, scripts, and AI prompts delivered as part of an implementation remain Klikwork's property until full payment is received.
After full payment, the Client receives a non-exclusive, perpetual license to use the materials and deliverables for their internal business operations.
Klikwork retains the right to reuse and adapt general components, templates, and AI logic in other projects.
Any misuse may result in legal action under Dutch law.

Each Party undertakes to keep confidential all non-public information it receives from the other Party, and not to use it for any purpose other than the performance of the Agreement.

This section applies only to fixed-price implementation projects.
Deliverables are considered accepted 10 business days after delivery, unless the Client reports specific defects in writing within that period.
Minor bugs or functional issues will be resolved within 10 working days on a best-effort basis.
Klikwork does not guarantee specific outcomes from AI-based solutions. The Client is responsible for human review and any final decisions based on AI outputs.
This clause does not apply to training, coaching, or hourly-based consultancy.

6. Use of Third-Party Tools
Klikwork integrates third-party services, including OpenAI, Microsoft Azure, Meta (formerly WhatsApp), and n8n, into its solutions.
If the Client provides credentials, API keys, or account access, they must be delivered in a timely manner.
If Klikwork provides temporary access (e.g., for testing): use is limited to the agreed scope and may incur additional costs.
Klikwork is not responsible for pricing changes, outages, or policy restrictions imposed by these external providers.

7. Data hosting & privacy
Klikwork prioritises tools and infrastructure that are EU-hosted or GDPR-compliant, where reasonably possible.
Some tools (e.g., OpenAI, Meta) may process data outside the EU. Klikwork limits exposure and configures privacy settings as restrictively as possible.
The Client is responsible for evaluating these tools in accordance with their compliance requirements.
Data processing agreements (DPAs) are available for services where Klikwork acts as a processor, as applicable under the GDPR.
Some tools (e.g., OpenAI, Meta) may process data outside the EU. Klikwork limits exposure and configures privacy settings as restrictively as possible.
The Client is responsible for evaluating these tools in accordance with their compliance requirements.

8. Liability
Klikwork’s liability is limited to the lesser of:
a) the amount paid by the Client for the relevant service, or
b) €25,000.

Klikwork is not liable for:
- ndirect or consequential damages
- Profit loss, reputational harm, or business interruption
- Claims from third parties
- Indemnification clause
- The Client agrees to indemnify and hold Klikwork harmless from any claims, damages, or liabilities arising from:
- The use or misuse of Klikwork’s services, materials, prompts, workflows, or advice
- Third-party claims resulting from actions taken based on AI outputs or automation processes
- Any breach of applicable laws (including GDPR or the EU AI Act) caused by the Client’s implementation or use of delivered solutions
- This includes legal costs, fines, and damages, unless caused by proven gross negligence or willful misconduct on the part of Klikwork.
9. Confidentiality
Both parties will treat any non-public information exchanged under this Agreement as confidential.
This includes all code, prompts, workflows, and business information.

10. Support (optional)
- Optional support packages are available.
- Standard response time: 2 business days.
- If the Client modifies workflows or code without approval, support coverage lapses.

12. Termination
This section applies only to fixed-price implementation projects. Each party may terminate the Agreement immediately in case of:
- A data breach
- Misuse of AI tools
- Non-payment
All deliverables and work completed up to the termination date remain billable and payable by the Client.
13. Disputes and applicable law
- Parties will first seek to resolve disputes amicably.
- Unresolved disputes will be submitted to the competent court in the Netherlands.
- Dutch law applies to all agreements and these Terms.
- All legal proceedings will be conducted in the Dutch language.
